This visa petitions to bring your fiancée (K-1 visa) and the fiancée’s children to the United States for the purpose of marriage. It can also be used to bring your spouse and your spouse’s children (K-3 and K-4 visas) to the United States to complete processing for permanent resident status. The K-1 visa is valid for a period of four months. However, the beneficiary will be able to apply for an employment authorization document (EAD), which is valid for a period of 2 years.
» The petitioner must file a petition with United States Citizen and Immigration Services (USCIS) on form I-129F
» Once the petition is approved the petitioner will be notified by USCIS on form I-797C
» USCIS will inform the U.S. Consulate in the beneficiary’s foreign country. The beneficiary will then follow instructions on Form I-792C to schedule an interview for visa stamping through the consulate.
